Introduction and acceptance

These Terms of Service (“Terms”) govern your access to and use of the website, mobile application, and related services (together, the “Platform”) operated by Purepicked Private Limited, a company incorporated under the Companies Act, 2013, with its registered office in Ghaziabad, Uttar Pradesh, India (“purepicked”, “we”, “us”, “our”).

By creating an account, browsing, placing an order, or otherwise using the Platform, you (“user”, “you”, “customer”) agree to be bound by these Terms, our Privacy Policy, and our Shipping Policy and Returns & Refunds policy, all of which are incorporated by reference. If you do not agree, do not use the Platform.

Eligibility

You must be at least 18 years of age and competent to enter into a valid contract under the Indian Contract Act, 1872 to use the Platform and place orders. By using the Platform, you represent that you meet these requirements. If you are using the Platform on behalf of a minor or another person, you represent that you are authorised to do so and accept responsibility for their compliance with these Terms.

Account registration

To place an order, you may need to create an account using accurate, current, and complete information, including a valid phone number and/or email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at care@purepicked.store of any unauthorised use of your account.

Nature of the Platform

purepicked operates as a curated online marketplace and reseller for third-party food and grocery brands. Except where explicitly stated, purepicked is not the manufacturer of the products listed on the Platform. The brand shown against each product (“Vendor”) is responsible for that product’s manufacturing, ingredients, packaging, labelling, and regulatory compliance under applicable Indian law, including the Food Safety and Standards Act, 2006 and the Legal Metrology Act, 2009.

purepicked reviews and screens listed products against publicly available FSSAI regulations and, where available, third-party lab reports, and displays a “verdict” or similar indicator reflecting the outcome of that screening at the time of listing. This screening is provided as a general informational aid to help you make purchase decisions. It:

• is not a certification, endorsement, warranty, or guarantee by purepicked of the ongoing safety, quality, or regulatory compliance of any product;
• does not substitute for reading the product’s own label, allergen information, and manufacturer instructions before consumption;
• may not reflect changes the brand makes to its formulation or packaging after our review; and
• should not be relied upon as medical, dietary, or professional advice.

If you have specific health conditions, allergies, or dietary restrictions, please verify product suitability directly against the product’s packaging before purchase or consumption.

Product listings, pricing, and availability

We make reasonable efforts to ensure product descriptions, images, nutritional information, and prices are accurate and current, based on information provided by brand suppliers. However:

• Product images are for representation; actual packaging, quantity, or appearance may vary.
• Prices are subject to change without prior notice, and the price applicable is the one displayed at the time your order is confirmed.
• We reserve the right to correct pricing, description, or availability errors, including after an order is placed, and to cancel affected orders with a full refund.
• Stock and availability are not guaranteed until your order is confirmed.

Orders and order acceptance

Placing an order on the Platform is an offer to purchase, which we may accept or decline at our discretion — including in cases of suspected fraud, pricing or listing errors, unavailability of stock, or serviceability issues at your delivery address. A contract of sale is formed only upon our confirmation of your order (via email or SMS) and, for prepaid orders, successful payment. We reserve the right to limit order quantities per customer or address.

Pricing, taxes, and payment

All prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise. We accept all major cards and UPI. Cash on delivery is not available at this time.

Payment is processed through RBI-authorised third-party payment gateways; we do not store your full card, UPI, or net-banking credentials. You agree to provide valid and authorised payment information. In the event of a failed or disputed payment, we may cancel or suspend your order until payment is resolved.

Delivery

Delivery timelines, serviceable areas, delivery slots, and delivery charges are governed by our Shipping Policy, incorporated into these Terms by reference. In summary: we deliver pan-India through delivery partners (typically 2–3 days), with hyperlocal slot-based delivery in Delhi NCR (typically 2–3 hours, with same-day and next-day slot options); delivery is free on orders of ₹999 or more. Delivery timelines are estimates and may be affected by weather, traffic restrictions, serviceability constraints, or events beyond our reasonable control (see Section 14, Force Majeure).

Returns and refunds

Returns and refunds are governed by our Returns & Refunds policy, incorporated into these Terms by reference. We do not offer product exchanges.

In summary: issues with perishable items must be reported within 24 hours of delivery and all other items within 48 hours. Email care@purepicked.store or WhatsApp us on +91 87967 99735. Refunds are issued for items that are damaged, defective, incorrect or missing. Refunds are credited to the original payment method within 5–7 working days, subject to the payment aggregator’s processing timelines. Proof of purchase is required in all cases. We do not issue store credit or credit notes in place of a refund.

User conduct

You agree not to:

• provide false, misleading, or fraudulent information when placing an order or creating an account;
• use the Platform for any unlawful purpose, or in a way that infringes the rights of purepicked, brand suppliers, or third parties;
• attempt to interfere with, disrupt, reverse-engineer, or gain unauthorised access to the Platform, its systems, or data;
• resell products purchased on the Platform for commercial purposes without our prior written consent;
• upload or transmit any content that is defamatory, obscene, infringing, or otherwise unlawful.

We reserve the right to suspend or terminate accounts that violate these Terms, and to decline refund requests where we reasonably believe the returns policy is being used abusively or fraudulently.

Intellectual property

All content on the Platform — including text, graphics, logos, product verdicts, ratings, and images — is owned by purepicked or licensed from our brand suppliers, and is protected under Indian copyright, trademark, and other intellectual property laws, as further described in our Privacy Policy. You may not copy, reproduce, modify, distribute, or create derivative works from this content without our prior written consent.

Third-party brands and sellers

Where products are supplied by third-party brands, those brands remain solely responsible for the accuracy of their product information, ingredient disclosures, regulatory compliance (including FSSAI licensing and Legal Metrology requirements), and product quality and safety, in accordance with the Consumer Protection (E-Commerce) Rules, 2020. purepicked acts as a marketplace facilitator for these listings and, except as required by law, does not assume liability for defects, non-compliance, or misrepresentation by the brand supplier, without prejudice to your statutory rights as a consumer.

Limitation of liability

To the maximum extent permitted under Indian law, purepicked’s aggregate liability for any claim arising out of or relating to your use of the Platform or any order shall not exceed the amount paid by you for the relevant order. We are not liable for indirect, incidental, consequential, or special damages, including loss of profit or data, arising from your use of the Platform, except to the extent such exclusion is not permitted by applicable law, including the Consumer Protection Act, 2019.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable Indian law, including liability for death, personal injury caused by proven negligence, or fraud.

Force majeure

purepicked shall not be liable for any delay or failure in performance (including delivery delays) resulting from causes beyond our reasonable control, including natural disasters, adverse weather, strikes, traffic or transport restrictions, government action, pandemics, or other events of force majeure.

Indemnification

You agree to indemnify and hold harmless purepicked, its officers, directors, employees, and brand suppliers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Platform, or violation of applicable law.

Grievance redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, grievances relating to the Platform may be directed to:

Dispute resolution and governing law

These Terms are governed by the laws of India. In the event of a dispute, you agree to first raise the issue with our Grievance Officer for resolution. If unresolved within 30 days, either party may refer the dispute to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual agreement, seated in Ghaziabad, Uttar Pradesh, and conducted in English. Subject to the above, the courts at Ghaziabad, Uttar Pradesh shall have exclusive jurisdiction. Nothing in this clause affects your right to approach consumer fora under the Consumer Protection Act, 2019, including the National Consumer Disputes Redressal Commission’s e-filing mechanism, as applicable.

Amendments

We may revise these Terms from time to time to reflect changes in our business practices or applicable law. Updated Terms will be posted on the Platform with a revised “Last updated” date, and continued use of the Platform after such changes constitutes your acceptance.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
